Important Notice — Please Read Carefully These Terms and Conditions ("Terms," "Agreement") are a binding legal agreement between you ("you," "your," "Customer," or "Member") and 1st Class Heat & Air, a Texas-licensed HVAC contractor ("Company," "we," "us," or "our"), governing your use of the website located at https://1stclassairservice.com (the "Site"), your purchase of any HVAC products or services, and your enrollment in the Comfort Club Membership Program. By accessing the Site, requesting service, scheduling an appointment, purchasing equipment, or enrolling in the Comfort Club, you agree to be bound by these Terms. This Agreement contains a binding arbitration provision and class action waiver in Section 18.

1. About Us

1st Class Heat & Air is a residential and light commercial HVAC contractor serving the Dallas–Fort Worth metroplex.

2. Acceptance of Terms

By using the Site or engaging us for HVAC services, you represent that you (a) are at least eighteen (18) years of age, (b) have the legal capacity to enter into a binding contract, (c) own the property at which services are to be performed or have authorization from the property owner, and (d) agree to comply with these Terms and all applicable laws.

We may modify these Terms at any time. Updated Terms will be posted on the Site with a new Effective Date. Continued use of the Site or our services after changes constitutes acceptance of the revised Terms.

3. Services Offered

We offer residential and light commercial HVAC services including, but not limited to:

  • Air conditioning installation, repair, and maintenance
  • Heating and furnace installation, repair, and maintenance
  • Heat pump systems
  • Indoor air quality (IAQ) products and services
  • Smart thermostat installation
  • Ductwork inspection, repair, and replacement
  • Comfort Club Membership Program (Section 7)
  • Emergency HVAC service

All services are performed by licensed and insured technicians in accordance with applicable Texas state and local codes.

4. Scheduling, Arrival & Access

4.1 Appointment Windows

Appointments are scheduled within arrival windows. While we make every effort to arrive on time, scheduling may be impacted by emergencies, weather, parts availability, and prior service complications.

4.2 Customer Access

You agree to provide safe, unobstructed access to the equipment, electrical panels, attic spaces, and outdoor units required to perform the requested service. If access is unsafe, blocked, or denied, we may reschedule the visit and a trip fee may apply.

4.3 Cancellations & No-Shows

Appointments may be canceled or rescheduled at no charge with at least twenty-four (24) hours' notice. Missed appointments without notice, or appointments where no adult (18+) is present at the scheduled time, may incur a trip fee.

4.4 Emergency Service

Emergency and after-hours service is available subject to technician availability. Emergency service rates may apply and will be disclosed at the time of dispatch.

5. Estimates, Pricing & Payment

5.1 Estimates

Diagnostic findings and written estimates are provided before non-emergency repair or installation work begins. By approving an estimate (verbally, electronically, or in writing), you authorize the Company to perform the described work at the quoted price.

5.2 Pricing Changes During Work

If unforeseen conditions are discovered during a job (hidden damage, code violations, prior improper installation, etc.), we will pause work and provide a revised estimate. Work will not resume until you approve the change.

5.3 Payment Terms

Payment is due upon completion of service unless financing has been arranged in advance. We accept major credit cards, debit cards, ACH transfers, and approved financing.

5.4 Financing

Financing is offered through third-party providers, including Synchrony. All financing is subject to credit approval and the lender's terms. 1st Class Heat & Air is not a lender and makes no representations regarding interest rates, approval likelihood, or final loan terms.

5.5 Late Payments

Unpaid balances may accrue interest at the maximum rate allowed by Texas law. You agree to pay all reasonable costs of collection, including attorneys' fees, in the event of nonpayment.

5.6 Promotional Offers

Coupons, rebates, and promotional offers are valid for the period stated, cannot be combined unless explicitly stated, may exclude emergency service, and are subject to availability. Promotions are void where prohibited.

6. Warranties & Guarantees

6.1 Quality Workmanship Guarantee

We stand behind every job. If our workmanship does not meet the standard you were promised, we will return to make it right at no additional charge during the applicable workmanship warranty period.

6.2 Equipment & Manufacturer Warranties

HVAC equipment we install carries the manufacturer's warranty. Warranty terms, registration requirements, and coverage periods vary by manufacturer and model. We will provide warranty documentation at the time of installation and will assist with warranty claims as a courtesy. Manufacturer warranty obligations are between you and the manufacturer.

6.3 Limitations

Warranties do not cover damage caused by misuse, neglect, lack of regular maintenance, power surges, acts of God, modifications by unauthorized parties, or use of non-OEM parts not supplied by us.

7. Comfort Club Membership Program

7.1 Program Overview

The Comfort Club is a recurring HVAC maintenance membership program designed to keep your heating and cooling system operating safely, efficiently, and reliably year-round. Membership includes priority service, scheduled preventive maintenance, exclusive discounts, and other benefits described in current enrollment materials.

7.2 Membership Pricing

Comfort Club membership is offered at a flat rate of:

  • $29.95 per month (month-to-month), or
  • $349 per year (save money by paying in advance!)

Pricing is subject to change with thirty (30) days' written notice to active Members. Pricing in effect at the time of enrollment will remain in effect for the current billing term.

7.3 Included Benefits

Active Comfort Club Members receive:

  • Two (2) precision tune-ups per year (one cooling, one heating) on covered equipment
  • Priority scheduling ahead of non-Members
  • Waived after-hours/emergency dispatch fees (where applicable)
  • Exclusive Member-only discounts on repairs and parts
  • Loyalty credits toward future equipment replacement, as detailed in current Member materials
  • No diagnostic fee on covered service calls
  • Equipment performance reporting after each visit

Specific benefits, discount percentages, and loyalty credit accrual rates are as described in the Comfort Club enrollment materials in effect at the time of your visit. We reserve the right to modify benefits with reasonable notice to active Members.

7.4 Term & Auto-Renewal

Comfort Club is a month-to-month membership unless you have entered into a promotional agreement for a fixed term (e.g., 3, 6, or 12 months). Membership renews automatically at the end of each billing cycle until canceled.

7.5 Promotional Term Agreements

From time to time, we offer promotional discounts (such as a discounted service call or installation credit) in exchange for the Member's agreement to maintain Comfort Club membership for a fixed period (e.g., 3 months, 6 months, or 12 months). If you accept a promotional offer with a fixed term:

  • You agree to maintain active membership for the full promotional term
  • Early cancellation may result in repayment of the promotional discount or early termination fee, as disclosed at the time of enrollment
  • Promotional terms convert to standard month-to-month membership at the end of the promotional period unless otherwise specified

7.6 Cancellation

You may cancel your Comfort Club membership at any time by contacting our office at (972) 673-0408 or in writing. For month-to-month memberships, cancellation takes effect at the end of the current billing cycle and benefits cease upon cancellation.

For promotional fixed-term agreements, cancellation prior to the end of the agreed term is subject to Section 7.5 (Promotional Term Agreements).

7.7 No Refunds

Comfort Club membership fees are non-refundable. No refunds, credits, or pro-rated returns are issued for partial billing periods, unused tune-up visits, or any other reason. Cancellation prevents future billing but does not refund prior payments.

7.8 Recurring Payment Authorization

By enrolling in the Comfort Club, you authorize us (or our payment processor) to charge your designated payment method on a recurring basis at the agreed rate until you cancel. You agree to keep your payment method current. If a payment fails, we may suspend benefits and attempt to collect using methods permitted by law.

7.9 Eligibility & Coverage

Comfort Club benefits apply to the residential address on file and are non-transferable. Each address requires its own membership. We reserve the right to decline coverage of equipment that is, in our reasonable judgment, beyond economical service, improperly installed by another party, or otherwise ineligible. Such determination will be communicated to the Member.

7.10 Not a Warranty or Insurance Policy

The Comfort Club is a maintenance and discount program. It is not an extended warranty, service contract, or insurance policy. It does not guarantee equipment performance or pay for repairs or replacement parts beyond included tune-up labor and inspections.

7.11 Scheduling of Tune-Ups

Tune-up visits are scheduled at the Member's request during normal business hours, subject to availability. We recommend scheduling cooling tune-ups in spring and heating tune-ups in fall. Failure to schedule and complete tune-ups during the membership term does not entitle the Member to a refund or credit.

8. Intellectual Property

All content on the Site — including logos, trademarks, service marks, text, graphics, photographs, video, software, and the design and arrangement thereof — is the property of 1st Class Heat & Air or its licensors and is protected by United States and international intellectual property laws.

The marks "1st Class Heat & Air," "Comfort Club," and any associated logos and slogans are trademarks of the Company. You may not copy, reproduce, modify, distribute, or create derivative works from any Site content without our prior written consent.

9. Permitted Use of the Site

You agree not to:

  • Use the Site for any unlawful purpose or in violation of these Terms
  • Attempt to gain unauthorized access to any portion of the Site, our servers, or related systems
  • Introduce viruses, malware, or other harmful code
  • Scrape, harvest, or collect data from the Site by automated means without written consent
  • Impersonate any person or misrepresent your affiliation with any person or entity
  • Interfere with or disrupt the Site or servers connected to the Site

10. User Submissions & Forms

When you submit information to us through the Site (service requests, contact forms, chat, reviews, photos, etc.), you grant us a non-exclusive, royalty-free, worldwide license to use that information for the purpose of responding to your inquiry, providing service, and improving our business.

You represent that any content you submit is accurate, lawful, and does not infringe the rights of any third party.

11. SMS & Text Message Consent

By providing a mobile number on our forms or during scheduling, you consent to receive transactional and service-related text messages from 1st Class Heat & Air, including appointment confirmations, technician dispatch notifications, follow-up communications, and Comfort Club service reminders. Message and data rates may apply. Reply STOP to opt out at any time. Reply HELP for assistance.

We do not sell mobile numbers or SMS opt-in data to third parties for marketing purposes.

12. Privacy

Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference and available at https://1stclassairservice.com/privacy-policy. Please review it to understand our practices regarding the collection, use, and disclosure of personal information.

13. Third-Party Links & Services

The Site may contain links to third-party websites, services, or content (including financing applications, manufacturer pages, and review platforms). We do not endorse and are not responsible for the content, accuracy, privacy practices, or policies of third parties. Your interactions with third parties are solely between you and that third party.

14. Disclaimers

The Site and all services are provided on an "as is" and "as available" basis. Except for the express warranties stated in Section 6, we disclaim all warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. We do not guarantee specific energy savings, equipment performance results, or air quality outcomes, as actual results depend on factors outside our control (including building conditions, climate, usage patterns, and third-party equipment).

15. Limitation of Liability

To the maximum extent permitted by law, in no event shall 1st Class Heat & Air, its owners, officers, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, loss of use, or property damage, arising out of or in connection with the Site, our services, or the Comfort Club, regardless of the legal theory.

Our total aggregate liability for any claim arising from or related to these Terms, the Site, or any service will not exceed the amount paid by you to the Company for the specific service giving rise to the claim in the twelve (12) months preceding the event.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of certain damages, so some of the above limitations may not apply to you.

16. Indemnification

You agree to defend, indemnify, and hold harmless 1st Class Heat & Air and its owners, employees, contractors, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of (a) your breach of these Terms, (b) your misuse of the Site or our services, (c) your violation of any law or third-party right, or (d) inaccurate information you provide.

17. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. The federal and state courts located in Collin County, Texas shall have exclusive jurisdiction over any claim or dispute that is not subject to arbitration under Section 18.

18. Dispute Resolution — Arbitration & Class Action Waiver

18.1 Informal Resolution

Before filing any claim, you agree to first contact us at (972) 673-0408 and attempt to resolve the dispute informally. Most issues can be resolved quickly through direct communication.

18.2 Binding Arbitration

If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms, the Site, our services, or the Comfort Club shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall be conducted in Collin County, Texas, or remotely as agreed by the parties.

18.3 Class Action Waiver

You and the Company agree that each may bring claims against the other only in an individual capacity and not as a plaintiff or class member in any purported class, collective, or representative action.

18.4 Exceptions

Either party may bring an individual action in small claims court or seek injunctive relief in court for misuse of intellectual property without resorting to arbitration.

19. Force Majeure

We are not liable for any delay or failure in performance caused by events beyond our reasonable control, including acts of God, severe weather, natural disasters, fire, labor disputes, supply chain disruptions, government action, pandemics, or utility failures.

20. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect, and the invalid provision shall be modified to the minimum extent necessary to make it enforceable.

21. Entire Agreement

These Terms, together with our Privacy Policy and any executed service agreement, estimate, or Comfort Club enrollment form, constitute the entire agreement between you and 1st Class Heat & Air with respect to the subject matter hereof and supersede all prior agreements, oral or written.

No waiver of any provision shall be deemed a continuing waiver. Our failure to enforce any right or provision shall not constitute a waiver of that right or provision.

22. Assignment

You may not assign or transfer these Terms or any rights hereunder without our prior written consent. We may assign these Terms in connection with a sale, merger, or reorganization of our business.
