The short version. We’re a family-owned HVAC company. We collect the information we need to fix your AC, schedule your appointments, send tune-up reminders, and process payments — and that’s it. We don’t sell your data. We don’t rent your contact list. We use a small set of trusted vendors (Podium, our payment processor, our scheduling system) to run the business, and we hold them to the same privacy standards we hold ourselves.

This page explains the details — what we collect, how we use it, who we share it with, and what choices you have. If you ever want us to delete your information, just call (972) 673-0408 or email us. We’ll handle it.

1. Who we are

This privacy policy explains how 1st Class Heat & Air, Inc. (“we,” “us,” “our,” or “1st Class”) handles personal information collected through our website (1stclassairservice.com), our phone lines, our online booking, our text-message communications, and our in-home service visits.

2. Information we collect

We only collect the information we need to provide HVAC service and run our business. That includes:

Information you give us directly

  • Contact information: name, address, email, phone number
  • Service information: the make/model of your HVAC system, service history, problem description, photos you send us
  • Payment information: credit/debit card, ACH info, financing application data (handled by our payment processor and financing partner — we don’t store full card numbers on our systems)
  • Communications: the content of your calls, texts, emails, online chats, and online booking submissions
  • Comfort Club membership info: if you join our maintenance plan, we keep your enrollment, billing, and service-history records

Information we collect automatically

  • Website usage: when you visit 1stclassairservice.com, we collect standard web-server data (IP address, browser type, pages visited, referring site, timestamps) using cookies and similar tools. See Section 6 below.
  • Analytics: we use Google Analytics and similar tools to understand how visitors use the site so we can improve it.

Information from third parties

  • Reviews you leave: if you publicly review us on Google, Facebook, BBB, Yelp, Birdeye, HomeAdvisor, Angi, Houzz, or similar platforms, we may see and respond to those reviews.
  • Referrals: if a neighbor or friend refers you to us, we’ll have your name and contact information from them.

3. How we use your information

We use your information to:

  • Provide the service you asked for — schedule appointments, send technicians, complete repairs and installs, deliver warranty support
  • Communicate with you — appointment confirmations, technician ETA texts, follow-ups, tune-up reminders, warranty notifications, and answers to your questions
  • Process payments — including financing applications if you request them
  • Manage your Comfort Club membership — billing, scheduling, service history
  • Improve our service and our website — internal analytics, customer feedback, training
  • Send marketing and special offers — only if you opt in (see Section 7), and you can unsubscribe any time
  • Comply with the law — tax records, warranty law, code-compliance documentation, responding to lawful requests

We do not sell your personal information. We do not rent or trade your contact list.

4. Texting and SMS — TCPA consent

When you give us your mobile number on a service form, online booking, Podium request, or by texting us first, you consent to receive text messages from us about your appointment, your service, and your account. Standard message and data rates may apply.

You can opt out of text messages at any time by replying STOP to any text from us, or by calling (972) 673-0408 and asking to be removed.

For marketing texts (special offers, seasonal promos), we only send those if you separately opt in. Opting out of marketing texts will not affect transactional service messages (like “your tech is on the way”).

5. Who we share your information with

We share your information only with the vendors and partners we need to run the business, and only to the extent necessary:

We require every vendor in this list to handle your information consistently with this policy and with applicable law.

6. Cookies and online tracking

Our website uses cookies and similar technologies for:

  • Necessary functions — keeping the site working, remembering your form entries, processing online bookings
  • Analytics — understanding aggregate traffic patterns (Google Analytics)
  • Advertising — measuring and targeting ads on Google, Meta/Facebook, and other networks (only if you’ve consented via the cookie banner, where applicable)

You can control cookies through your browser settings. You can opt out of Google Analytics tracking at tools.google.com/dlpage/gaoptout. You can opt out of Google personalized advertising at adssettings.google.com.

7. Your privacy rights

Depending on where you live, you may have the right to:

  • Know what personal information we have about you
  • Access a copy of that information
  • Correct inaccurate information
  • Delete your information (subject to legal record-keeping obligations like tax and warranty law)
  • Opt out of marketing communications, targeted advertising, and the “sale” or “sharing” of your information for cross-context behavioral advertising
  • Appeal a denied request

Texas residents (TDPSA — Texas Data Privacy and Security Act)

If you are a Texas resident, you have specific rights under the TDPSA (effective July 1, 2024), including the rights listed above. To exercise any of these rights, contact us using the information in Section 12. We’ll verify your identity (so we don’t send your data to the wrong person) and respond within 45 days.

If we deny your request, you have the right to appeal — and if your appeal is denied, you may file a complaint with the Texas Attorney General at oag.my.texas.gov.

Other states

If you live in another U.S. state with comprehensive privacy law (California, Virginia, Colorado, Connecticut, Utah, etc.), you may have similar rights under your state’s law. Contact us and we’ll honor those rights to the extent applicable.

How to make a request

Email service@1stclassairservice.com or call (972) 673-0408 and tell us what you’d like — access, correction, deletion, opt-out, or appeal. We’ll guide you through it.

8. Data retention

We keep your information only as long as we need it to:

  • Provide ongoing service (active customers and Comfort Club members)
  • Honor warranties (typically 5–10 years for installs)
  • Comply with tax, accounting, and code-enforcement obligations (typically 7 years)
  • Defend against legal claims

When we no longer need it, we securely delete or anonymize it. If you ask us to delete your information sooner, we will — except for records we’re legally required to keep.

9. How we protect your information

We use reasonable physical, technical, and administrative safeguards to protect your information, including:

  • Encryption for sensitive data in transit (HTTPS on the website, encrypted payment processing)
  • Access controls — only employees and vendors who need your information have access to it
  • Vendor agreements that require third parties to protect your data
  • Background checks on every technician who enters your home

No system is 100% secure, but we work hard to keep your data safe.

10. Children’s privacy

Our services are intended for adults — homeowners, renters, and property managers. We don’t knowingly collect personal information from children under 13. If you believe a child has given us information, contact us and we’ll delete it.

11. Changes to this policy

We may update this policy from time to time as our services, technology, or the law changes. When we do, we’ll update the “Last updated” date at the top, and for material changes we’ll post a notice on the website (and email or text active customers if appropriate).
