These Terms and Conditions ("Terms") govern your use of our website at 1stclassairservice.com and all heating, ventilation, air conditioning, and related services ("Services") provided by 1st Class Heat & Air ("Company," "we," "us," or "our"). By accessing our website, requesting a quote, scheduling service, or engaging us to perform any work, you ("Customer," "you," or "your") agree to be bound by these Terms. If you do not agree, please do not use our website or Services.
Acceptance of Terms
By using our website, submitting any form, or requesting or receiving Services from 1st Class Heat & Air, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and the Company.
If you are entering into these Terms on behalf of a business, organization, or other entity, you represent that you have the authority to bind that entity to these Terms, and "you" and "your" shall refer to that entity.
You must be at least 18 years of age to use our Services or website. By agreeing to these Terms, you represent that you are at least 18 years old.
Services Provided
1st Class Heat & Air provides residential and commercial heating, ventilation, and air conditioning services, including but not limited to:
- HVAC system installation, replacement, and upgrades
- Heating and air conditioning repair and diagnostics
- Preventative maintenance and tune-up services
- Indoor air quality assessment and solutions
- Ductwork inspection, cleaning, repair, and installation
- Thermostat installation and smart home HVAC integration
- Emergency HVAC repair services
The specific scope of work for each job will be outlined in a written estimate or service agreement provided to the Customer prior to work commencing. Any changes to the scope of work may require a revised estimate and additional authorization from the Customer.
Scheduling & Property Access
By scheduling a service appointment, you agree to provide our technicians with safe, reasonable, and unobstructed access to the work area, including all HVAC equipment, electrical panels, attics, crawl spaces, and other areas necessary to perform the requested Services.
You are responsible for:
- Ensuring someone 18 years or older is present at the property during the scheduled service window, or providing alternative access arrangements approved in advance
- Clearing the work area of personal belongings, obstructions, and hazards prior to the technician's arrival
- Securing all pets during the service visit
- Disclosing any known hazards, including but not limited to asbestos, mold, structural damage, or pest infestations in or near the work area
We will make every reasonable effort to arrive within the scheduled service window. However, service times are estimates and may be affected by prior appointments, traffic, weather, or emergency calls. We will notify you of significant delays when possible.
Pricing & Payment
Estimates & Quotes
All pricing provided by 1st Class Heat & Air, whether verbal or written, is an estimate unless expressly stated as a fixed-price quote in writing. Estimates are valid for 30 days from the date issued unless otherwise specified. Final pricing may vary based on actual conditions discovered during the course of work, including hidden damage, code requirements, or additional parts and labor needed.
Diagnostic & Service Fees
A diagnostic or service call fee may apply for on-site evaluations. This fee covers the technician's travel and time to assess your system. The diagnostic fee will be communicated at the time of scheduling. In some cases, the diagnostic fee may be applied toward the cost of approved repairs.
Payment Terms
Payment is due upon completion of Services unless other arrangements have been agreed upon in writing. We accept the following forms of payment: cash, check, and major credit/debit cards. For larger projects (installations, replacements), a deposit may be required prior to ordering equipment. The deposit amount and payment schedule will be outlined in the service agreement.
Financing options may be available through third-party providers. Financing is subject to credit approval and the terms of the financing provider. 1st Class Heat & Air is not the lender and is not responsible for the terms, conditions, or decisions of any third-party financing company.
Late Payment
Invoices not paid within 30 days of the due date may be subject to a late fee of 1.5% per month (or the maximum rate permitted by applicable law, whichever is less) on the outstanding balance. The Customer is responsible for all costs of collection, including reasonable attorney's fees, if collection action becomes necessary.
Warranties & Guarantees
Workmanship Warranty
1st Class Heat & Air stands behind the quality of our work. We provide a workmanship warranty on labor performed, the duration of which will be specified in your service agreement or invoice. During the warranty period, if a defect in our workmanship is identified, we will return to correct the issue at no additional charge.
Manufacturer Warranties
Equipment and parts installed by 1st Class Heat & Air may carry manufacturer warranties. These warranties are provided by the equipment manufacturer, not by 1st Class Heat & Air, and are subject to the manufacturer's terms, conditions, and registration requirements. We will assist with manufacturer warranty claims when applicable, but the final determination of warranty coverage is made by the manufacturer.
Warranty Exclusions
Warranties do not cover:
- Damage caused by misuse, neglect, lack of maintenance, unauthorized modifications, or third-party service
- Normal wear and tear, including but not limited to filters, belts, and refrigerant levels
- Damage caused by power surges, lightning, flooding, fire, or other acts of nature
- Pre-existing conditions or defects not caused by our workmanship
- Systems or components not installed or serviced by 1st Class Heat & Air
Satisfaction Guarantee
Your comfort is our priority. If you are not satisfied with the Services provided, please contact us within 30 days of service completion. We will work with you in good faith to resolve any concerns.
Limitation of Liability
To the fullest extent permitted by applicable law, 1st Class Heat & Air, its owners, employees, agents, and subcontractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, arising out of or related to your use of our Services or website.
Our total aggregate liability for any and all claims arising out of or related to these Terms or our Services shall not exceed the total amount paid by you to 1st Class Heat & Air for the specific service giving rise to the claim.
1st Class Heat & Air is not liable for any delays in performance caused by circumstances beyond our reasonable control, including but not limited to supply chain disruptions, equipment backorders, or manufacturer delays.
Cancellation & Refund Policy
Service Appointments
You may cancel or reschedule a service appointment at no charge by providing at least 24 hours' notice prior to the scheduled appointment time. Cancellations made with less than 24 hours' notice may be subject to a cancellation fee.
Installation & Project Work
For installations and larger projects, cancellation terms will be outlined in the service agreement. Generally, if you cancel after equipment has been ordered or custom work has commenced, you may be responsible for restocking fees, non-refundable deposits, and any labor costs incurred up to the point of cancellation.
Refunds
Refunds, if applicable, will be processed using the original method of payment within 15 business days of the approved refund request. Refunds for completed work will be evaluated on a case-by-case basis and may be subject to deductions for work already performed and materials used.
Customer Property & Damages
Our technicians will exercise reasonable care while working on your property. However, HVAC work sometimes requires access to tight spaces, attics, crawl spaces, walls, and ceilings, and minor cosmetic disturbances (such as drywall access points or paint scuffs) may occasionally be unavoidable.
If you believe our technicians caused damage to your property during the course of providing Services, please report the damage to us within 48 hours of service completion. We will investigate all claims promptly and in good faith. Documented damage directly caused by our negligence will be repaired or compensated at our discretion.
1st Class Heat & Air is not responsible for pre-existing damage, damage caused by faulty construction or materials not installed by us, or damage resulting from the Customer's failure to disclose known hazards.
Permits, Licensing & Code Compliance
1st Class Heat & Air is a licensed and insured HVAC contractor operating in compliance with all applicable state and local regulations. Where required by law, we will obtain necessary permits for installation and major repair work. Permit fees, where applicable, will be included in the project estimate.
All work performed by 1st Class Heat & Air will be done in accordance with applicable building codes and industry standards. If existing conditions at the job site require additional work to bring the installation into code compliance, we will notify the Customer and provide a revised estimate before proceeding.
Indemnification
You agree to indemnify, defend, and hold harmless 1st Class Heat & Air, its owners, officers, employees, agents, and contractors from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of or in connection with: (a) your breach of these Terms; (b) your misuse of our Services or website; (c) your failure to disclose known hazards, pre-existing conditions, or relevant property information; or (d) any third-party claims related to your use of our Services.
Intellectual Property
All content on the 1stclassairservice.com website, including but not limited to text, graphics, logos, images, photographs, videos, and software, is the property of 1st Class Heat & Air or its licensors and is protected by applicable intellectual property laws.
You may not copy, reproduce, distribute, modify, display, perform, or create derivative works from any content on our website without prior written consent from 1st Class Heat & Air. Limited, personal, non-commercial use of our website content (such as printing a coupon or saving a quote) is permitted.
Privacy & Data Collection
Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our website or Services, you consent to the data practices described in our Privacy Policy.

Agreement to Receive Text Messages
By opting in to the 1st Class Heat & Air text messaging program, you agree to receive recurring automated and non-automated text messages from 1st Class Heat & Air to the mobile phone number you provided. These messages may be sent using an automatic telephone dialing system or other technology. Your consent to receive text messages is not a condition of purchasing any goods or services from 1st Class Heat & Air.

Costs & Message Frequency
Message frequency varies. Standard message and data rates may apply as determined by your wireless carrier. 1st Class Heat & Air does not charge for text messages, but you are responsible for any fees imposed by your mobile carrier. Check with your carrier for details on your messaging plan.
How to Opt Out
You may revoke your consent to receive text messages at any time by texting STOP to any message you receive from 1st Class Heat & Air. Upon receiving your opt-out request, we will send you a single confirmation message, and you will no longer receive text messages from us. If you wish to re-join our messaging program, you may opt in again by submitting a new request through our website or by contacting us directly.

1st Class Heat & Air reserves the right to modify or discontinue the text messaging program at any time, with or without notice. We may also amend these terms at our discretion. Your continued participation in the program after changes are posted constitutes acceptance of the updated terms.
Reviews & Customer Feedback
We value your feedback and may request reviews or testimonials after providing Services. Any reviews, testimonials, photos, or feedback you voluntarily provide may be used by 1st Class Heat & Air for marketing purposes, including but not limited to display on our website, social media, and advertising materials, unless you specifically request otherwise.
By submitting a review or testimonial, you grant 1st Class Heat & Air a non-exclusive, royalty-free, perpetual, and irrevocable license to use, reproduce, modify, and display such content in any media format.
Force Majeure
1st Class Heat & Air shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from events beyond our reasonable control, including but not limited to natural disasters, severe weather, pandemics, government actions or orders, utility failures, strikes, supply chain disruptions, equipment or material shortages, acts of terrorism, or civil disturbances.
In the event of a force majeure occurrence, our obligations will be suspended for the duration of the event, and we will use reasonable efforts to resume performance as soon as practicable. We will notify affected Customers of any significant delays caused by force majeure events.
Dispute Resolution & Governing Law
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles.
Informal Resolution
Before initiating any formal dispute resolution process, you agree to first contact 1st Class Heat & Air directly to attempt to resolve any dispute informally. We are committed to working in good faith to resolve issues quickly and fairly. Most concerns can be resolved through direct communication.
Binding Arbitration
If a dispute cannot be resolved informally within 30 days, either party may elect to resolve the dispute through binding arbitration administered by a mutually agreed-upon arbitration service in Collin County, Texas. The arbitrator's decision shall be final and binding on both parties. Judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction.
Class Action Waiver
To the extent permitted by law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against 1st Class Heat & Air.
Modifications to These Terms
1st Class Heat & Air reserves the right to update, modify, or replace these Terms at any time at our sole discretion. Material changes will be indicated by updating the "Last Updated" date at the top of this page. Your continued use of our website or Services after any changes are posted constitutes your acceptance of the updated Terms.
We encourage you to review these Terms periodically. For significant changes that materially affect your rights or obligations, we will make reasonable efforts to notify you through our website or other communication channels.
Severability & Entire Agreement
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall continue in full force and effect.
These Terms, together with our Privacy Policy and any service agreements or estimates provided to you, constitute the entire agreement between you and 1st Class Heat & Air regarding the subject matter herein and supersede all prior or contemporaneous understandings, agreements, representations, and warranties, both written and oral.
The failure of 1st Class Heat & Air to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
